          Racial vilification is not a chargeable crime is it? Assault is. So Benji is in some trouble. He should have never put himself in that situation!!

              Exactly. That's why famous people need to behave themselves. The bloke probably deserved what he got (or maybe not - he doesn't have a manager spinning stories to the Sun Herald), but deliberately punching someone is naughty.

                  I do feel for Marshall and his family.

                  Called such a name and he can't retaliate. The world has gone crazy.

                  I'm not black but I'd feel humiliated to be called this by a loser who hasn't achieved anything in his life by comparison. Then he goes and dobs to the Police.

                  I've met too many like this bloke in my life to have any compassion for him.

                  I support Marshall as I have Carney before him.

                    I thought he admitted to it quite publicly, giving the excuse that they racially abused him? Regardless of the reason, he's committed a common assault and admitted to it, so the cops should have no difficulties charging him. I'm surprised they didn't do it quicker (although I still think it's a joke that he can get charged, when there were carnts being racist who probably deserved it.)

                    The law sux with these things... saying "they were racist bastards and wound me up" has very little weight. If he's made a guy scared and hurt him physically (then fessed up), then I can't see a magistrate saying "oh but they were being racist, so violence was your best option... good option Benji! I wish more large, muscular men would react violently when teased by random people on the street..."

                    I think it's more for murder or more serious offenses where you're looking to explain your actions (in order to get out of life imprisonment.) Regardless of his motivation, punching a guy (but not hurting him or doing any more damage) probably won't have anybody thrown in gaol if it's their first offence.

                    That said, Benji will probably get a criminal record, and will have to explain himself every time he travels to the USA, or applies for a government job. In addition he probably won't be able to get clearance to work with kids.

                    The problem with these things is that they stick... not that you get punished harshly or anything.

                          The way I look at it, if the guy had been legless and Benji hit him, and the bloke did a David Hookes, he could be up for manslaughter.

                          I say, if he did it, he's bloody lucky it's only an assault charge.

                          If you can't hack being called a black C or have someone take the piss then you shouldn't go out.

                          I've been called four eyes, fat arse, fat f***, fat C*** and other names too, I've never hauled off and hit anyone.

                            Is there any proof Marshall was racially abused? The problem is it seems the assault was premeditated, goes away, comes back with a mate and whacks the guy... This is why he is some bother.

                              I don't know if this is the case but if it is then the guy is as much of a meathead as Carney and Watmough. Maybe even more as the other two were not premeditated. It will be interesting to see what Gallop does now that he has been charged. A suspension may not be warranted but will he be sacked as the face of the NRL?
