Mind you the Dragons should have insisted on formal release papers from the Tigers back when Moltzen signed, and Moltzen shouldn't have signed anything until that was available.
As it stands, the only contract registered with the NRL for 2012 for Moltzen is with the Tigers. The Dragons cannot have their later contract with Moltzen registered with the NRL until there is proof available to the NRL that the Tigers have agreed to a release from that contract.

The Dragons have done nothing wrong in this case and I applaud them for taking a stance. I think even if they win the case they won't make Moltzen move as there's no point in havig a player that doesn't want to be there. They are making this stand as a point of principle.
The Tigpies have conducted themselves very poorly in this case. They realised that once they were going to be forced to sack Lui, they have no half back and asked Moltzen if he wanted to stay and then did not act in the good faith that verbal releases are given with.
Moltzen hasn't exactly come out of it smelling of roses either. If he has a poor season and Wests wan to dump him again, he could struggle to pick up another club.
In future clubs will be very wary in dealing with them.

Legally he cant play for the dragons until the Tigers have signed papers releasing him from the final year of his contract...
It seems commonplace in the NRL but what will be crucial is if the Tigers had signed anything or there is evidence they said anything verbal to the Dragons that Moltzen will definately be released
Dragons have been unprofessional in this situation as well
the correct verion of events would be:
1. Tigers gives permission to player to look around - check
2. Player seeks offers, recieves them and decides on one - check
3. Tigers agree to let player go by signing relase - No
4. Dragons and player sign contract after relase is granted - Or to protect player pending release is granted - No
There are contractual agreements that can protect a player in between them gaining a release and signing a new contract
