    Yes an assault can be verbal. However, this doesn't mean that every heated argument between an estranged couple is an assault. You've gotta intentionally or recklessly make somebody feel scared that they will cop some form of physical violence.

    I don't think it's a good idea to get into heated domestic disputes and people who start them may well be absolute scum. However, you can't just assume a crime's happened because a couple got emotional and had an argument.

      So you feel that she wouldn't have felt scared or threatened by a very large drug induced man of questionable integrity . Verbal, emotionall, physical , it is all wrong in the eyes of the law .As you would know even affray is about threatening rather than assault

          Well said Ism. The thing is that you have to have been in an acrimonious marital break up to have some sympathy with this Burgess situation. Even the strongest men can be reduced by the awful prospect of losing their family and when they realise that there is no going back they can lose emotional control and there can be a degree of violence. We learn about the most tragic results regularly.
          What I see being played out here is not unusual but a complete absence of context, a public personality and what I would imagine to be, interfering family (especially a powerful individual with an agenda) makes it so.

            Men can make choices. Weak men choose violence, bullying and intimidation. Strong men choose to deal with things

            There should be no sympathy for any man who acts violently towards a women.

                Is pushing and shoving by both sides violence? There's no evidence that anything other than that occurred and I have suggested plausible alternative scenarios.

                I had an acrimonious marriage breakdown back in the day. A tough father -in- law got involved. The wife would great me in the mornings and at every other opportunity with "Fcuk off!". I was never violent towards her but I did wait outside the lover's house and eventually took my frustration out on him. Despite things looking very much cut and dried, the result in the ensuing assault case went my way.

                Like Burgess, I probably deserved to be put off the bus but, also like him, I was young and the fact that children are involved doesn't make things easy for even the mentally strongest of men. Mind you, there are a lot of men who want out out even with children involved and, obviously, they take things calmly.

                It sickens me that News Ltd has gone for the jugular with even a follow up piece in the Weekend Australian but that's their style. Those drunken hacks don't have any high purpose with this, there's an agenda and, in my opinion, it's the Mitch Hooke family reputation.
