You heard them talk about Syd turning up to rehearsals a year or two after he left. He was obese with a shaved head and the others didn't even recognise him at first.

How many people have lost their license for 6 months and had to make other arrangements to get around, after having 3 beers and getting pinged, having never had a single driving offence or other law infringement before in their lives?

I'm no choirboy but I detest meth and how it ruins lives , I have little sympathy for the beast if he was importing ice it's a scourge on society.

Yeh when they recording the wish you were here album - they noticed this bloke sitting in the studio and thought he must be someone's friend who works there(Abbey Road) - Rick Wright went and spoke to him and came back and told Waters/Gilmour and Mason who he was (Syd Barrett - he had returned to his original name by then Roger Barrett) - they were shocked after not having seen him for years.

Any way they bought him lunch etc and then he was telling them how he had some ideas for new songs ( mmm been 7 odd years since he was in Pink Floyd ) -anyway he said he had to go and they asked him where - oh home - took him a week to get back home to Cambridge from London as i think Waters kept in contact with Syd's Sister.

They had a 6 gig residency at some club in London (UFO) i think - may have been the the 5th ot 6th one they decided not to pick him up and that was that they went from a 5 piece to a 4 piece band - Gilmour originally was brought into the group to basically play and sing Syd's part when he didn't- cases of him just standing on stage not playing or singing at all was common and increasing.

Waters had enough when Syd was playing his new song to him and wanting him to play along -Have you got it yet - kept on changing the music and lyrics so Waters couldn't follow it - eventually Waters gave up and told Syd - you know what i have got it unplugged his bass and took it off and never played again with him- Hence the lyrics in Brain Damage " And if the band you're in starts playing different tunes I'll see you on the dark side of the moon "

I remember Waters saying Vegetable Man and Jugband Blues was Syd Barrett's self assessment of his mental state at the time

" And all the lot is what I got, It's what I wear, it's what you see, It must be me, it's what I am, Vegetable man"

" It's awfully considerate of you to think of me here And I'm much obliged to you for making it clear That I'm not here" - Jugband Blues

I just checked the bench book and (surprisingly) the courts' guidance has been updated to be a bit more lenient. Guidance used to be that nobody is to be given a section 10 for DUI or drug driving because both are considered very serious offences. Now the guidance in NSW's bench book is...

                              > Limitations on use of s 10 Crimes (Sentencing Procedure) Act 1999 — s 203
Section 10 Crimes (Sentencing Procedure) Actis not available to a defendant for an “applicable offence” if, at the time of or during the 5 years before the court’s determination, a previous s 10 has been applied in relation to another “applicable offence”. Applicable offences are set out in s 203(2) and include:
                              • certain drink/drug driving offences
                              • furious, reckless or menacing driving (ss 117(2) or 118)
                              • offences of failing to stop and assist (ss 146 or 52AB Crimes Act 1900 )
                              • an offence of negligent driving causing death or GBH.
                              ---

HOWEVER... IMO anybody else would be looking at having a butt ugly mandatory interlock system installed in all their fancy European cars (after a period of ~6-18 months without a license).

                              > Part 7.4 Div 2 Road Transport Act provides for a mandatory alcohol interlock program for offenders convicted of certain alcohol-related offences. When Pt 7.4 was introduced on 1 February 2015, s 203 relating to limitations on the application of s 10 Crimes (Sentencing Procedure) Act 1999 to certain offences under the Road Transport Act 2013 was not amended.

                              > Section 210: A court that convicts a person of a “mandatory interlock offence” must, at the time of conviction, make one of the following orders in respect of the person:
                              (a) a mandatory interlock order
                              (b) an interlock exemption order.

                              > Section 209 contains all definitions relevant to Pt 7.4 Div 2. In particular, a “mandatory interlock offence” is an offence against s 110(1)–(3) (driving with the novice, special or low range prescribed concentration of alcohol), that is a second or subsequent offence by the offender for any other alcohol-related major offence. Further, s 209 defines first, second and subsequent offences of high and middle range drink driving (s 110(4) and (5)), driving under the influence of alcohol or any other drug (s 112), and refusing breath analysis or to provide samples (cll 16 and 17, Sch 3), as mandatory interlock offences.

                              ---

I'm not gonna spend all day combing through the relevant legislation and the bench book. However, IMO it is VERY surprising that negligent driving in an unlicensed, unregistered car (over a period of 10 years as he was never licensed/registered) then being busted with alcohol and cocaine in your system would USUALLY result in:
                              - Convictions being recorded
                              - Mandatory interlock
                              - Losing your license
                              - (Relatively) good character grounds amounting to something like 'we are not gonna be sensing you to prison this time + giving Immigration a call about whether you still meet the character test to be here... if I see you again with this sorta shyte then that's where this will go... now fark off and try to be a semi-decent human being for once!!!'
